All materials available on the www.panika-shop.hr web site are exclusively intellectual property of Lavago d.o.o, and may only be used with the express authorisation of the copyright holder, trademark and/or design right holders. Lavago d.o.o. makes it possible to use the services and content of the web site www.panika-shop.hr as governed by these Purchase Terms.

These Purchase Terms are a part of the Seller's obligations under the Consumer Protection Act and serve to make the Buyer aware of a number of circumstances relevant to the conclusion, execution, termination of the contract and all compliance with the law before concluding a distance contract.

 

The term Seller refers to the company LAVAGO d.o.o., Zagreb, Petrinjska 48, Personal identification number (OIB): 50858418139, MBS: 0278637, T: 01/4817 876 W: www.panika-shop.hr.

 

The term Buyer refers also to: a traditional consumer/a natural person who, without any activity, orders and pays any product through the web store service available on the Seller's website, but it also refers to the buyers such as craftsmen, individuals and physical persons engaged in business, which are protected by the provisions of the Consumer Protection Act only if they buy products not related to their business, and to all other customers, for example, legal persons.

Seller selling through www.panika-shop.hr website performs on its own.

Purchase terms are part of the contract concluded at a distance together with the specifications and the price of the purchased product, and prior to the confirmation of the purchase order for a particular product the Buyer will request that it accept / declare that it is familiar with it, and after confirming the order (contract termination) shall be delivered to the Customer as the content of an e-mail confirming that the contract was concluded. The Seller reserves the right to change the terms at any time, provided that such changes will take effect upon publication on these web sites.

When the Buyer confirms and executes the order, the contract is concluded and the Seller will immediately notify via email that the contract has been concluded.

For a validly concluded contract it is necessary that the Buyer is a person who has full business ability.

The buyer is responsible for the completeness and authenticity of the entered data when registering.

Purchase terms are divided into lower classified categories / information.

Access to the web site www.panika-shop.hr may sometimes be unavailable due to maintenance or update of new content and in the case of unforeseen circumstances beyond the Seller's control which the Seller will attempt to remedy in the shortest possible time.

 

 

 

Main features of the goods: the products are depicted in descriptive form and photographs, and their data is made on the basis of the database.

Product photos are of illustrative nature and do not always and completely match all the products that are the subject of the order. The Seller specifically points out that the visual identity of a product displayed on a photograph does not have to match the actual appearance of the product, in particular with regard to the monitor settings of the customer’s computer and the customer’s perception of colors seen on the screen, etc. In the case of the above discrepancy between the products shown in the photograph and the delivered product is not a product defect.

Product data (product description, price, etc.) displayed on the web site www.panika-shop.hr are subject to bugs, improper workflow, other technical malfunctions, typographical errors, etc. In case of obvious errors or malfunctions in terms of data about the products displayed at www.panika-shop.hr the Seller reserves the right to terminate the contract unilaterally.

 

Only products which are marked as available can be ordered. Due to the large number of orders submitted to www.panika-shop.hr at the same time, the availability of the product may not be the same to the stock available in the warehouse.

If the ordered product is not available in the warehouse, the Seller will notify the Buyer that the product is not currently available, when the product will be available, and also offer the option of purchasing an alternative product from www.panika-shop.hr with the characteristics closest to the product that cannot be delivered.

 

 

 

The prices shown on the website www.panika-shop.hr are quoted in kunas. Tax is included in the price of the product. The cost of the product is indicated by the delivery costs. Before order confirmation, the product price, delivery price, tax price, and final price are displayed separately for the Buyer to see the final price which will be paid for the ordered purchase service. In the case of payment via e-banking and with general payment slips, costs of payment and / or interbank transactions are not included in the price.

 

 

 

The products are ordered by selection, use of the menu and fill in the electronic form. Buyer can order and buy the product as a registered or unregistered user. The product is deemed to be ordered when the buyer completes the entire order process. 

 

Payment of ordered products can be done in the following ways:

 

In the case of credit card payment, general payment slips and e-banking payment must be processed at the latest within the deadline indicated in the email confirming that the contract was concluded. With regard to credit card payment, the Seller points out that the card payment system is integrated into the pages. After selecting the card payment method, the fields for entering the card information will be opened. Information regarding the cards and the owner are not kept on vendor servers. If the system refuses to authorize card payments, you must select one of the alternative payment methods. The Seller has no data on the reasons of card rejection which can be of a technical or a business nature. 

 

In case that the Customer wants to pay in cash, it is necessary to choose E-banking payment. In that case, it is good to forward the payment receipt so the order can be processed as soon as possible.

 

If the buyer does not receive the notice that the order was received after the completion of the ordering process, it is suggested to check if:

• the message is in the Junk / Spam folder

• the mailbox if full

 

In case that the payment is not processed within the specified time period, the Seller will also act upon the subsequent payment outside of the delivery deadline of the purchased products and if it cannot make the delivery for a justified reason, the order will be canceled and the paid amount will be refunded.

If the payment is executed neatly and visible on the Seller's account, the Seller will deliver the ordered products. The invoice is included in the shipment along with goods.

Ordered products are delivered to the entire territory of the Republic of Croatia, Slovenia, Serbia, Bosnia and Herzegovina and Montenegro. Delivery is done via HP Express.

Delivery will take place no later than 15 business days after the visible payment on Seller's account. In case that it is not possible to deliver the goods in one shipment due to the availability of the products on the stock, the Seller reserves the right to deliver products in more than one shipment.

Delivery is done in accordance with the terms of delivery service use and is deemed to have taken place at the time of product delivery to the delivery service.

Orders during the working days (except Friday) will be delivered on the next day, while orders submitted on Fridays will be submitted on Monday. Orders received on Saturdays and Sundays are processed on Mondays. After goods are delivered to the delivery service, a shipment number will be sent to customer’s email address in order that he/she can check the shipment status at the email address of the delivery service. Unfortunately, the Seller is unable to influence the delivery speed and possible complications related to delivery service. For each shipment, the Buyer verifies and signs the delivery note upon receipt of the shipment.

 

 

 

The Seller is liable for the material defects of the items he sells on his sites in accordance with the positive regulations of the Republic of Croatia, in particular with the Civil Obligations Act. Ordered products are packaged in a way that they will not get damaged during the regular transport / delivery. In case the shipment gets damaged in transport, the Seller will not be held responsible. Upon receipt of goods, the order confirmation of the order depends on the buyer, and the buyer is obliged to compare the received items with the invoice. If something is missing the buyer is obliged to instantly submit a written complaint as the subsequent complaints will not be accepted. It is considered that products duly received by the Buyer did not have a noticeable defect and the Seller does not accept the complaints in regards to them. Products that are duly received cannot be returned to the Seller.

The Seller undertakes to maintain the privacy of all personal data of all buyers and shall treat it in accordance with the Personal Data Protection Act or other applicable regulations. 

 

The Seller shall not use or make available all above personal information to the third parties without permission, except where such special law allows or this is necessary for the purpose of fulfilling the contractual obligations. All Seller’s and Business Partner’s employees are responsible for compliance with the privacy policy.

 

In the event of any change of personal data (e.g. place of residence, delivery address) which is recorded during registration, the buyer is obligated to inform the vendor at the mail address of www.panika-shop.hr. In case the buyer does not want that the Seller processes these data any more and requests the deletion of these data, he/she must inform the seller by e-mail to the e-mail address info@panika-shop.hr.
